DOL Audits – ACA Information Requests Recently, the DOL has been using its investigative authority to enforce compliance with healthcare reform law. The following are documents and information you may be expected to provide, regardless of grandfather status: Notice describing enrollment rights for adult children (up to age 26) Documents relating to annual or lifetime limits Documents describing wellness or disease management programs Information related to preventive services For grandfathered plans they are also asking for: Records evidencing grandfather status Notice to participants advising of such status A description of benefits provided under the plan Employers that receive DOL audit letters may be surprised and overwhelmed by the number of documents requested by the DOL auditor. Although employers generally have no way of knowing whether they will be selected for a DOL audit, it is important that they retain documents that will help them respond to an audit request in the event this occurs. Inadequate responses to the DOL could trigger additional document requests, interviews, on-site visits and even DOL enforcement actions.
